Advocating For The Rights Of All Types Of Families
Expanding your family through either adoption or guardianship is a rewarding experience. However, the legal process can be lengthy, draining and complex.
At Lavin & Parisi, Attorneys at Law, we have advocated for the rights and interests of both nontraditional and traditional families across Illinois for over 35 years. Attorney John Parisi and his team can guide you throughout the process of seeking adoption and guardianship of a minor.
Establishing Guardianship To Make Legal Decisions
As a guardian, you assume the rights to make legal decisions for a child. While the biological parents still have financial obligations toward their child, you will make decisions related to their care, education, health and more.
We can assist throughout the process of establishing guardianship. Depending on your situation, the process can be complex, including filing a petition with the court, obtaining a letter of consent from biological parents, interviewing with all interested parties, agreeing to a home inspection and more.
The court ultimately acts in the best interests of the child. We will represent you in court to show your ability and willingness to assume such responsibilities.
Seeking Adoption Of A Child
Unlike guardianships, an adoption terminates the biological parents’ rights to their child. The adoptive parents then assume all responsibilities for the child’s care. We can assist with various types of adoptions, including:
- Stepparent adoptions to adopt a stepchild
- Foster parent adoptions to adopt a child in their care
- Adoptions by other relatives, including when biological parents are unfit to raise their child
- International or domestic adoptions, including those through third-party agencies
To adopt a child, the biological parents must give consent to terminate their rights. Depending on your situation, obtaining this consent can be difficult. We can assist throughout the process of participating in interviews, filing paperwork with the court and representing your interests.
We have considerable experience in advocating for the rights of all types of families. With a long history of working with LGBT couples, we can offer knowledgeable assistance when same-sex couples wish to expand their family through adoption.
