Is virtual visitation right for me in Illinois?

If you've heard of virtual visitation, it's likely that you have thought about how it could fit into your life. Going through a child custody battle is never easy. Coming to an agreement on your own with the other parent can be very challenging, especially if you've never gotten along.

That's where the court will jump in and make a decision in the best interest of your child. If you can't be present in the same area as your child, you may need to explore many options.You may find yourself wondering, "is virtual visitation right for me?"

First off, what is virtual visitation? As you can imagine, it has a lot to do with technology. Virtual visitation is the use of a tablet, smartphone or computer to communicate with your child when you physically cannot be with them. Emails, text messaging, video chats and FaceTime are all used to communicate with a child during virtual visitation.

Who should apply for virtual visitation as part of a custody agreement? The following situations will be taken into consideration before a judge issues a ruling on virtual visitation:

  • If the parent has moved far away from the child
  • If the parent has been deployed in the military
  • If the parent is on a business trip
  • If the child is on vacation with the custodial parent
  • If the parent is incarcerated

Take a look at your current situation and see if any of the above apply. If so, it might be a good idea to apply for virtual visitation as part of your child custody agreement.

Deciding whether or not virtual visitation should be part of your child custody agreement can be difficult for both parents. This is a method that should only be used sparingly, and when necessary, and not as a replacement for physical custody and visitation in person.
