What is an Uncontested Divorce?

A divorce is "uncontested" when spouses agree on each and every issue in their divorce. For a divorce to be uncontested, all of the divorce issues must be resolved between the spouses outside of court and prior to the filing of the petition for the dissolution of the marriage.

The court process begins when the couple files the petition for dissolution. The petition is filed and it includes a marital settlement agreement. The marital settlement agreement provides for:

  • the division of all property and debts,
  • spousal support (if applicable),
  • and if there are children,
  • custody,
  • the allocation of parental rights and responsibilities,
  • parenting time and
  • child support.

We will represent only you during the divorce proceeding. One major advantage to the uncontested divorce proceeding is that only the spouse that filed for divorce needs to appear at the final hearing.

If at any point your divorce matter becomes contested, we still can represent you.
